ANJANA PRAKASH ORAL ORDER 15-04-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Section 396 of the I.P.C.

The petitioner was refused bail by order dated 29.01.2015 by this Court on consideration that he was absconding for a number of years.

It has been submitted that the petitioner had already surrendered before the District Administration as is evident from Annexure-3.

In view of such, let the above named, petitioner be released on bail on furnishing bail bond of Rs. 5,000/- (Five Thousand) with two sureties of the like amount each or any other surety to be fixed by the Court below to the satisfaction of Sri P. Krishna, learned J.M. Ist Class Bagaha,

Patna High Court Cr.Misc. No.8525 of 2015 (2) dt.15-04-2015 District-West Champaran in connection with Tr. No. 2502/2014 arising out of Chautarwa P.S. Case No. 92/1999, subject to the conditions:

(i) That one of the bailors will be a close relative of the petitioner, who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner, (ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.

The District Magistrate, West Champaran may consider withdrawal of the cases against the petitioner in view of him having given shelter to such persons if there is no further complication.
