JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-03-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Petitioner happens to be full brother of the deceased and independent witnesses vide paragraphs no. 6, 7, 8 and 9 of the case diary stated that on the alleged date of occurrence on account of family feud deceased committed suicide. Moreover, police after due investigation, submitted charge sheet under Section 306 of the I.P.C.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above

Patna High Court CR. MISC. No.2850 of 2019(5) dt.28-03-2019 2/2 named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Abhishek Kumar Bhan, learned Judicial Magistrate, 1st Class, Rohtas, Sasaram in connection with Sheosagar P.S. Case No. 257 of 2018.
