Civil Review No.279 of 2017 ====================================================== Suresh Giri & Ors ... ... Petitioner/s

Versus

The State Of Bihar & Ors ... ... Respondent/s ====================================================== Appearance :

For the Petitioner/s :

Mr. Arbind Kumar Singh For the Respondent/s :

Mr. PRABHAT KUMAR VERMA (AAG 3) ====================================================== CORAM: HONOURABLE MR. JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 13-10-2017 Heard both sides.

The petitioner, who was private respondent in the writ petition, has filed the present application for review of the order dated 12.05.2016 passed in C.W.J.C. No. 7627 of 2016. It is contended that without issuing notice to them, the order was passed. The operative part of the said order reads as under:- "So far as property is concerned, the petitioner has a remedy of approaching the court under the provisions of the Cr.P.C. for passing appropriate orders. In so far as providing protection to the petitioner is concerned, in my view, the petitioner should make an application in this regard before the Sr. Superintendent of Police or the District Level Security Committee for providing him the protection with or without cost. The Court presumes that if any such application is filed, the same shall receive due consideration and disposal in accordance with law at the hands of the State respondent(s)/Committee, as the case may be.

Patna High Court C. REV. No.279 of 2017(3) dt.13-10-2017 2/2 This disposes of this writ application."

Counsel for the State has rightly contended that the said order does not prejudice, in any manner, the case of the petitioner.

In the considered view of the Court, the present review application is completely misplaced. It is accordingly rejected. (Kishore Kumar Mandal, J) Pankaj/- U
