Three motorcycles alleged to be stolen one were seized from the houses of Lalbabu Chaudhary, Bhola Chaudhary and Janak Chaudhary respectively. During course of interrogation they disclosed to have purchased the same from Anil Sahani, the petitioner. That means to say there happens to be inculpatory extra judicial confessional statement of a co-accused against the petitioner. From the order impugned it is evident that save and except presence of one case as criminal antecedent nothing more has been collected by the Investigating Officer.

Patna High Court Cr.Misc. No.18079 of 2015 (2) dt.21-05-2015 Accordingly, petitioner Anil Sahani is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Bairiya P.S. Case No.253 of 2014.
