JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner and one Md. Naushad Ansari were caught when they were going on a motorcycle but petitioner was pillion rider. The petitioner was produced before the court but the court refused to remand the petitioner as the police had not complied with the provision of Section 41 (a) of the Criminal Procedure Code but subsequently, petitioner was again produced before the court below and he was remanded in the present case. Petitioner does not have any criminal antecedent and is languishing in jail custody since long.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.9623 of 2016 (2) dt.29-02-2016 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur, Ara in connection with Koilwar P.S. Case No. 288 of 2015.
