JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-03-2019 The petitioner apprehends his arrest in connection with Chenari P.S.Case No. 199 of 2018 registered under Sections 30(a) of the Bihar Prohibition and Excise Act. Allegation against the petitioner is that on information received by police that petitioner is selling illegal liquor , police proceeded and seeing the police party, he fled away throwing Jhola from which two and half litres of liquor has been recovered.

Submission of learned counsel for the petitioner is that petitioner has no criminal antecedent and whole prosecution story is false and concocted.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed,

Patna High Court CR. MISC. No.5299 of 2019(3) dt.13-03-2019 2/2 in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge 2nd -cum-Special Judge, Excise, Rohtas at Sasaram in connection with Chenari P.S. Case No. 199 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
