2. The petitioner seeks bail in connection with Nathnagar P.S. Case No. 639 of 2023 registered for the offence punishable under Sections 341, 323, 307, 504 and 506/34of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner is said to have fired upon the victim. The injury report supports the allegation. The petitioner is in jail since 22.08.2023.

4. It has been submitted by learned counsel for the petitioner that the petitioner has prior dispute with the informant.

5. At the outset, learned counsel for the petitioner without accepting the guilt of the petitioner has submitted that

Patna High Court CR. MISC. No.5954 of 2024(2) dt.17-02-2024 2/2 the petitioner is ready to compensate the victim by paying an amount of Rs. 45,000/- as medical assistance.

6. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge, Bhagalpur in connection with Nathnagar P.S. Case No. 639 of 2023.

7. At the time of furnishing the bail bonds, the petitioner shall furnish a demand draft of Rs. 45,000/- prepared in the name of the victim. If the petitioner furnishes the demand draft of Rs. 45,000/-, the Court below shall accept the bail bonds of the petitioner and hand over the said demand draft to the victim.
