1. Heard learned counsel for the petitioners and learned APP for the State.

2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 341, 323, 308, 354, 304 and 34 of the Indian Penal Code.

The learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that she went to attend call of nature when Sujit grabbed her and took her towards the river side with bad intention, but she raised an alarm when her cousin came and accused fled, thereafter villagers took her to the house of

No.3124 of 2025(3) dt.08-05-2025 2/3 accused when named accused started abusing and when her cousin and family members objected, it is alleged that Sandeep assaulted Arvind by khanti causing injury on head, thereafter, Sujeet assaulted Lalo with khanti causing injury on hand and near the ear and thereafter, Akhilesh and Sunil assaulted Chandan by rod causing injury on back side of head and above the ear.

4. The learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is further submitted that it does not appear probable that had Sujit indulged in such an act, the informant along with the villagers would have come to the house of the petitioners. It is next submitted that on account of dispute relating to passage, an altercation had taken place in which both sides assaulted each other. It is also submitted that the injury suffered by the injured is simple in nature and the blow is not alleged to have been repeated.

5. Learned A.P.P. Sri Chandra Bhushan Prasad opposes the anticipatory bail application, but then, fairly submits that the injury suffered by the injured is simple in nature.

6. At this stage, the learned counsel appearing on

No.3124 of 2025(3) dt.08-05-2025 3/3 behalf of the petitioners submits that the parties have compromised the case, considering the submissions made by the learned counsel for the petitioners, the petitioners, abovenamed, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Gaya in connection with Wazirganj P. S. Case No.221 of 2023, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

7. The application stands allowed.
