The petitioner seeks bail in a case registered for the offence under Section 409 of the Indian Penal Code. The allegation against the petitioner is that as per the agreement, he was given Rs. Ten Lacs for supply of the materials, as per Nal-Jal Yojana, however; he has not completed the work.
It is submitted on behalf of petitioner that petitioner was not the contractor, rather he was only supplier of the materials. It was the duty of the contractor to complete the work. Petitioner is in custody since 25.11.2021. However, learned counsel for the informant vehemently opposed the bail petition.
Considering the aforesaid facts and circumstances as
Patna High Court CR. MISC. No.5023 of 2022(3) dt.16-05-2022 2/2 well as period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sikrahana at Dhaka, East Champaran in connection with Dhaka P.S. Case No. 214 of 2019.
