JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 15-05-2023 As both these bail applications have cropped up from the same police station case number, hence, with consent of parties, they are being heard together and disposed of by this common order.
Heard learned counsel for the petitioners, informant and learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 304(B)/34
Patna High Court CR. MISC. No.7842 of 2023(3) dt.15-05-2023 2/3 of the Indian Penal Code.
Petitioners are said to have committed murder of the daughter of the informant.
Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in this case. He submits that the husband of the deceased was not present in the house at the time of occurrence as he was out side in Pune (Maharashtra) for his livelihood. He submits that the petitioners in Cr. Misc No. 7972 of 2023 are the father-in-law and mother-in-law of the deceased and they are living separately. He further submits that petitioners have no criminal antecedent as stated in para-3 of this application. Learned APP for the State and learned counsel for the informant oppose the prayer for bail.
Considering the facts and circumstances of the case and the fact that there is no specific overt act against the petitioners in Cr. Misc. No. 7972 of 2023, let the above named petitioners in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below
Patna High Court CR. MISC. No.7842 of 2023(3) dt.15-05-2023 3/3 where the case is pending/successor court in connection with Sarai P.S. Case No. 108 of 2022, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
However, considering the facts and circumstances of the case and the fact that petitioner Ranveer Singh @ Ranveer Kumar @ Randhir Singh is the husband of the deceased, I am not inclined to enlarge the petitioner Ranveer Singh @ Ranveer Kumar @ Randhir Singh on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with the aforesaid case.
