The petitioner seeks bail in connection with Madanpur P.S. Case No. 162 of 2021 instituted for the offences under Sections 379, 420 and 120(B) of the Indian Penal Code read with Section 30(a) of the Bihar Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 07.07.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the allegation is of recovery of 2730 litres of spirit from a fourwheeler vehicle. Learned counsel for the petitioner submits that the petitioner was arrested from the spot and is alleged to be the

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-IIcum-Special Judge, Excise, Aurangabad, in connection with Madanpur P.S. Case No. 162 of 2021.
