JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 23-08-2024 This application has been filed seeking restoration of Cr.Misc.No.63591 of 2023 which stood dismissed for noncompliance of the order dated 17.10.2023.

2. Learned counsel for the petitioner submits that due to inadvertence requisites etc. for notice to the complainant/opposite party no.2 could not be filed within time.

3. It is submitted that in terms of the order dated 17.05.2024 the petitioner has handed over a Demand Draft No.333664 dated 08.07.2024 for Rs.2000/- in favour of the opposite party no.2.

4. In the aforesaid view of the matter, learned counsel

Patna High Court CR. MISC. No.30829 of 2024(3) dt.23-08-2024 2/2 for the opposite party no.2 does not object to the restoration of the criminal miscellaneous application.

5. Accordingly, this application is allowed.

6. Let the Cr.Misc.No.63591 of 2023 be restored to its original file.
