JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 394/34 of the Indian Penal Code.

It would appear from perusal of the impugned order that learned court below rejected the prayer for bail of the petitioner using his confessional statement as well as criminal antecedent and also that some arms were recovered from the house of one co-accused, Prince Kumar on the basis of confessional statement of petitioner. Petitioner is in jail custody since 05.12.2015 but it appears that up till now he has not been put on

Patna High Court Cr.Misc. No.11099 of 2016 (2) dt.10-03-2016 2/2 Test Identification Parade.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah Muffasil P.S. Case No. 627 of 2015.
