Petitioner seeks bail in a case registered for the offence punishable under Section 30(A) and 38 of the Bihar Prohibition and Excise Act, 2016.

Earlier bail of the petitioner was rejected vide order dated 01.10.2019 passed in Criminal Miscellaneous No. 53909 of 2019 with liberty to renew his prayer for bail after completing 6 months of jail custody.

Learned counsel for the petitioner submits that petitioner is in custody since 05.07.2019 and petitioner has completed more than 11 months of custody in jail. Learned counsel for the petitioner submits that

No.3388 of 2020(2) dt.12-06-2020 2/2 petitioner has voluntarily agreed to donate Rs. 5,000/- in "CHIEF MINISTER RELIEF FUND, BIHAR," IN THE ACCOUNT NO. 2065104000002257, IFSC CODEIBKL0002065, BANK-IDBI, BRANCH-KIDWAIPURI, PATNA, within 15 days after his release from prison. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of court below where the case is pending in connection with Excise Case No. 97 of 2018 PR. No. 11/18-19, with following conditions:-

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be represented on each and every date fixed by the court.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
