JUSTICE ANIL KUMAR SINHA ORAL ORDER 20-03-2020 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners seeks bail in connection with Ahiyapur Police Station Case No. 1119 of 2019, registered for the offences punishable under Sections 30(a)/36/38 of the Bihar Prohibition and Excise Act, 2016.

The allegation against the petitioners is that a truck, bering Registration No. DL1LS-5804 was intercepted by the police and recovered 2116.8 litres of illicit liquor from the said truck.

Learned Counsel for the petitioners submits that the petitioners are the driver and cleaner of the truck in question and

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that the petitioners are the driver and cleaner of the truck in question and they are in custody since 14.09.2019, I am inclined to enlarge the petitioners on bail.

This application is, accordingly, allowed.

Let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Muzaffarpur, in connection with Ahiyapur Police Station Case No. 1119 of 2019.
