Petitioner, in the present case, is seeking anticipatory bail in connection with Trial No. 823 of 2018 registered under Section 47(a) of the Bihar Excise Act, pending in the court of learned 9th Additional Sessions Judge - cum - Special Judge, Excise, East Champaran, Motihari.

Learned counsel for the petitioner submits that the present case is of the year 2009, petitioner has been falsely implicated in this case, no recovery has been made from the premises of the petitioner and petitioner has got no criminal antecedent.

Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioner.

No.5890 of 2020(3) dt.30-06-2020 2/2 Having regard to the facts and circumstances of the case wherein it is a case of the year 2009 and for the last 10 years petitioner did not submit himself to the jurisdiction of the Court because of which the trial has remained pending and even process under Section 82 and 83 Cr.P.C. has been taken out against the petitioner, this court is not inclined to grant privilege of anticipatory bail to the petitioner.

This application is dismissed.
