The petitioner is accused in connection with Siwan (Town) P.S. Case No. 300 of 2015, registered under Section 366(A)/34 of the Indian Penal Code.

The accusation is of enticing the minor daughter of the informant by this petitioner and one Vijay Kumar Yadav. Learned counsel for the petitioner submits that, in fact, the petitioner is the nephew of co-accused Vijay Kumar Yadav, who left the house on 17.07.2015 regarding which information was given by this petitioner to Town Police Station, Siwan on 20.07.2015 and the present case has been lodged by the informant on 21.07.2015. Further submission is that while the victim, daughter of the informant, has stated about carrying

No.9710 of 2016 (3) dt.03-05-2016 2/2 by Vijay Yadav and she has not stated any specific overt act or misbehaviour made by this petitioner, rather she has stated about committing rape by co-accused Vijay Yadav. Further submission is that, in fact, on the pressure of the informant, victim has disclosed the name of the petitioner in the present case. The petitioner is in custody since 21.11.2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in connection with Siwan Nagar (T) P.S.
