The petitioner seeks bail in a case under Section 302 and other sections of the Indian Penal Code.
The informant Binod Rai named the petitioner along with 21 other accused and alleged that Ravindra Yadav and Bhola Yadav fired killing Narayan Koda and Congress Koda near a temple. The extremists are also alleged to have fired killing Sunil Rai and Shivan Rai on the spot and Naresh Rai was severely injured. It is submitted that no specific allegation is made against the petitioner. It is also submitted that the petitioner is made accused in many other cases but, in most of the cases, the petitioner is not named. Even chargesheet has not been submitted. On perusal of the record, it appears that the petitioner is, of course, named in the F.I.R. but no specific allegation of firing is made
Patna High Court Cr.Misc. No.21693 of 2015 (2) dt.10-09-2015 2/2 against the petitioner. The case of the petitioner stands on the similar footing as that of Jago Yadav, who has already been enlarged on bail vide order passed in Cr. Misc. No. 18966/2012. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge III, Munger in Dharhara P.S. Case No. 74 of 2011, corresponding to S. Tr. No. 5 of 2015.
