The petitioner seeks bail in a case registered under Sections 363, 366A/34 of the Indian Penal Code. The prosecution case in brief is that while informant's daughter was going to market, the accused persons forcibly kidnapped her.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 17-11-2018. Charge sheet has already been submitted. There was love affairs between the victim and the petitioner. The victim had left home with her own sweet will. When she came in custody of her parents, under

Patna High Court CR. MISC. No.4704 of 2019(3) dt.15-04-2019 2/2 inducement she made statement under Section 164 of the Cr.P.C. As per medical report, the victim is major. While the victim was being taken away by the petitioner, no protest whatsoever was made by the victim.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Saran at Chapra in connection with Mashrakh P.S. Case No. 375 of 2018.
