ANSHUMAN ORAL ORDER 04-04-2025 Initially, it is submitted by the Learned Counsel for the petitioner that the present case has been filed in connection with Vijayepur P.S. Case No. 45 of 2023, but due to an inadvertent error, 'Vijayepur P.S. Case No. 45 of 2024' has been mentioned in the prayer portion of the petition. Therefore, Learned Counsel for the petitioner seeks permission to correct this error.
2. Permission is granted. Counsel for the petitioner is directed to make the necessary correction during the course of the day.
3. Heard Learned Counsel for the petitioner and Learned A.P.P. for the State.
4. The petitioner seeks regular bail in connection with
Patna High Court CR. MISC. No.3349 of 2025(2) dt.04-04-2025 2/3 Vijayepur P.S. Case No. 45 of 2023, lodged on 28.02.2023, under Sections 341, 323, 324, 307, 354(B) and 34 of the Indian Penal Code.
5. As per the prosecution, F.I.R. has been lodged against eight named accused persons, including the present petitioner, alleging that the accused attacked the informant on the head with a kudaal, causing injury.
6. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel further submits that both the informant and the petitioner belong to the same village and are relatives. The dispute arose due to a petty family issue. Counsel further submits that from the contents of the FIR, it appears to be a land dispute, which led to a scuffle between the family members, resulting in the informant's injury. The major Section in this case is Section 307 of the IPC, for which the petitioner has been in custody since 26.11.2024, and he has no criminal antecedents.
7. Learned APP for the State opposes the prayer for bail.
8. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail, on furnishing bail bonds of Rs.30,000/-
