ANJANA PRAKASH ORAL JUDGMENT Date: 02-07-2015 The Petitioner seeks revision of the judgment of conviction dated 4.4.2015 passed by the Adhoc Additional Sessions Judge VIII, Purnia in Criminal Appeal No.44 of 2014, by which he has confirmed the order of conviction and sentence of the Petitioner, passed on 12.3.2014 by the Judicial Magistrate, 1st class, Purnia in G.R. No.27 of 2014 arising out of Banmankhi P.S. case No.3 of 2014, under the provisions of arms Act and the period of three years and fine of Rs.2500/- and in default of which further R.I. for three months. It has been submitted that the Petitioner has remained in custody since 2.1.2014.
Having gone through the impugned judgments, I do not find any reason for interference. However, considering the period of
Patna High Court CR. REV. No.368 of 2015 dt.02-07-2015 2/2 custody of the Petitioner, the sentence is modified to the period already undergone by him. However, he is required to deposit the fine as directed by the Court below within a period of eight weeks from the date of receipt of this order, failing which he shall be sentenced to imprisonment as directed by the court below.
With the aforesaid modification in sentence, the revision application stands dismissed.
