JUSTICE SHIVAJI PANDEY ORAL ORDER 09-03-2017 Heard learned counsel for the petitioner and learned counsel for the State.

In this case prayer has been made on behalf of the petitioner for restoration of his licence no. 88f of 1985 under the Public Distribution System. The petitioner is a PDS dealer vide licence no. 88f of 1985. On receipt of complaint the licensing authority has cancelled the licence of the petitioner. Against that he has filed an appeal being Appeal no. 112 of 1991-92 which was allowed vide order contained in Memo no. 105 dated 30.01.1993 and the order of cancellation was set aside which was again remanded to the licensing authority. The matter has been remanded back before the licensing authority with regard to taking decision on merit but he has been sitting tight over the matter.

Patna High Court CWJC No.1900 of 2017 (2) dt.09-03-2017 2/2 Petitioner has filed representation before the licensing authority is pending consideraton.

Let the Sub Divisional Officer, Araria, take a fresh decision on the representation filed by the petitioner with regard to cancellation of his PDS licence within a period of three months from the date of receipt/production of a copy of this order.
