====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 20-06-2023 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 325, 307, 504 and 506/34 of the Indian Penal Code. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent. Allegation against the petitioner nos. 2 and 3 i.e. Jai Prakash Yadav and Kartik Kumar is of assaulting the informant and his daughter by an iron rod causing injury on their head and as far as petitioner no. 1 is concerned, he is alleged to have assaulted the informant by lathi causing fracture of two fingers.

Patna High Court CR. MISC. No.4973 of 2023(3) dt.20-06-2023 2/3 Learned counsel for the petitioners submits that the injury suffered by the informant on account of assault by petitioner no. 1 Ram Kumar Yadav is on non-vital part of the body.

On query of the Court, with regard to the injury suffered by the informant and his daughter on their head, learned counsel for the petitioners submits that he is not aware what is the nature of injury suffered by them. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Madhepura (Bharrahi) P.S. Case No. 630 of 2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. However, the learned court below before accepting the bail bonds of petitioner nos. 2 and 3 i.e. Jai Prakash Yadav

Patna High Court CR. MISC. No.4973 of 2023(3) dt.20-06-2023 3/3 and Kartik Kumar shall verify the injury report of the injured and in the event if it is found that the injury on head suffered by the informant and his daughter is grievous in nature then in that event, the present anticipatory bail order in their favour shall not be given effect to.
