02. In the present case, the petitioner seeks bail in connection with Complaint Case No. 1123 of 2019 wherein processes were directed to be issued after cognizance being taken for the offences under Sections 498A, 323, 341/34 of the Indian Penal Code.

03. As per prosecution case, the petitioner is the husband of the complainant and allegations are throwing out the complainant from her matrimonial home on account of non-

04. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner and the complainant have a child aged about three years and the petitioner wants to keep the complainant with honour and dignity but she is not ready for that and she refused to live with the petitioner. The complainant has been insisting that the petitioner should live separate from his aged parents and for this reason, she has filed this false case. The allegation of demand of dowry is completely false and no cognizance has been taken under any provision of the Dowry Prohibition Act and the cognizance has been taken under Sections 498A, 323, 341/34 of the Indian Penal Code. The petitioner has got no criminal antecedent and he is in custody since 02.06.2025.

05. Learned APP opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the nature of allegation against the petitioner and also considering the period of custody of the petitioner and his clean antecedent, the petitioner above named is directed to be released on bail on

No.3352 of 2026(2) dt.28-01-2026 3/3 furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Patna City/concerned Court in connection with C.A. Case No. 1123 of 2019, subject to the conditions mentioned in Section 480(3) of B.N.S.S. and also the following conditions: (i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below. (iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
