JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased and in course of investigation, it came to light that petitioner and deceased were in love and after that they had solemnized the marriage. It also came to light that deceased gave birth to three children after her marriage and petitioner and deceased started residing at Khusrupur in a rented house. The statement of landlord of petitioner has been recorded at para-59 of the case diary in which the landlord specifically stated that relation of the petitioner with deceased was very cordial and as a matter of fact, deceased developed some complications in her abdomen and she was taken

Patna High Court Cr.Misc. No.18879 of 2015 (3) dt.22-09-2015 2/2 for treatment but unfortunately, she could not be saved. The aforesaid fact has been stated by several witnesses.

Therefore, considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri R.V.S. Parmar, Judicial Magistrate 1st Class, Nalanda at Biharsharif in connection with Harnaut (Telmar) P.S. Case No. 387 of 2014.
