JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-06-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 419/420 of the Indian Penal Code.

As per the prosecution case, petitioner along with coaccused persons prepared some forged documents to commit fraud and instituted false suit before the court below against this informant and her son.

Petitioner is the tenant of the informant. This instant case has been lodged due to civil dispute between the parties. Petitioner has filed a Title Suit No. 40/2021/684/2021 against the informant and others before the Civil Court, Gaya, which is

Patna High Court CR. MISC. No.5113 of 2023(5) dt.19-06-2023 2/2 still pending. Only to pressurize this petitioner and to influence the Title Suit, the informant has lodged this case against the petitioner and his sons.

Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Gaya in connection with Civil Line P.S. Case No. 280 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
