The petitioner seeks regular bail in connection with Choraut P.S. Case No. 82 of 2019 for the offence registered under Section 30(A) of the Bihar Prohibition and Excise Act, 206.

The allegation is regarding recovery of 44.400 litres of illicit Nepali wine from the motorcycle of the petitioner. The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case. It is further submitted that the petitioner is having a clean antecedent. Lastly, it is submitted that the petitioner is languishing in custody since 20.11.2019.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel

Patna High Court CR. MISC. No.2306 of 2020(2) dt.16-01-2020 2/2 for the petitioner as also taking into account the fact that the petitioner is having a clean antecedent, I deem it fit and proper to direct for release of the petitioner herein on regular bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II-cum-Special Judge, Excise Act, Sitamarhi in connection with Choraut P.S. Case No. 82 of 2019.
