1. Heard Mr. Manish Kumar, learned counsel for the petitioners and Mr. Arun Kumar Pandey, learned APP for the State.

2. The petitioners seek regular bail in connection with Banmankhi P.S. Case No. 274 of 2022 dated 16.08.2022 registered for the offence(s) punishable under Sections 147, 149, 341, 323, 324, 307, 379, 504 of the Indian Penal Code.

3. As per the prosecution story, informant alleged that on 16.08.2022 accused persons along with petitioner and 34 unknown persons assaulted her uncle, namely, Sanjay Yadav, when her cousin brothers namely Shivan Kumar and Munna Kumar came to rescue their father, then they were also

Patna High Court CR. MISC. No.4649 of 2025(2) dt.15-02-2025 2/2 assaulted by the accused persons with iron road and dabiya and petitioner no.2 assaulted the informant .

4. Heard both the sides and perused the FIR.

In the facts and circumstances of this case and considering the averments made in the petition and mainly petitioners' the pleas that both the parties are co-villagers and the alleged occurrence relates to simple assault though one injured namely, Shivam Kumar sustained one grievous injury but the same has not been specifically attributed to both the petitioners and petitioner no.2 is alleged to have assaulted the informant who sustained simple injury and now both the parties have compromised and also coupled with petitioners' fair and clean antecedent and their custody period and completion of investigation against them, this court is inclined to grant the relief of regular bail to the petitioners. Accordingly, let the petitioners named-above be enlarged on bail in connection with Banmankhi P.S. Case No. 274 of 2022 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the Court concerned.
