JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-03-2019 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 384, 385, 504, 506/34 of the Indian Penal Code.

Petitioners and one Pawan Poddar @ Pawan Kumar Poddar are said to have demanded extortion money and gave threatening of dire consequences to the informant but co-accused Pawan Poddar @ Pawan Kumar Poddar has already been granted privilege of bail by a co-ordinate

Patna High Court CR. MISC. No.3959 of 2019(3) dt.29-03-2019 2/3 Bench of this court vide order dated 06.12.2018 passed in Cr. Misc. No. 72882 of 2018 taking note of this fact that on the alleged date of occurrence above stated co-accused Pawan Poddar @ Pawan Kumar Poddar had not been produced before the court.

No doubt, petitioners were admittedly produced before the court in connection with another case on the alleged date of occurrence and they do have criminal antecedent of near about four cases but considering the facts and circumstances of the case as well as this aspect of the matter that petitioners are in jail custody since 20.07.2018, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Shri Ashish Ranjan, learned Judicial Magistrate-1st Class, Araria in connection with Araria P.S. Case No. 467 of 2018, subject to condition that if petitioners make any attempt to terrorize the prosecution witnesses in the present case as well as in other case, the prosecution shall be at liberty to file petition for cancellation of bail before the trial court and if prosecution does so, the learned trial court shall
