JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-01-2019 This is an application for grant of anticipatory bail in connection with Bhagwanpur Hat P.S. Case No. 195 of 2018, disclosing offences under Sections 272, 273, 308, 420 of the Indian Penal Code and Sections 30(a), 41(1) of the Bihar Prohibition and Excise Act 2016.

Allegation is of recovery of 40 liters liquor from the house of the petitioner.

Submission of learned counsel for the petitioner is that the house is a joint house and nothing has been recovered from his conscious possession. Further, he has no criminal antecedents.

Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above

Patna High Court Cr.Misc. No.4918 of 2019(2) dt.29-01-2019 2/2 named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge, II, Cum Special Judge, Excise, Siwan, in connection with Bhagwanpur Hat P.S.
