JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-03-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 366 of the Indian Penal Code. The statement of informant's wife was recorded under Section 164 of the Cr.P.C. in which she stated that petitioner took her to Delhi on pretext that her husband was seriously ill but in Delhi she was confined in a room by the petitioner. She further stated that anyhow petitioner agreed to drop her at Begusarai and after that she was dropped at Begusarai but while she was going to her home, she was caught by the police.

Contention on behalf of the petitioner is that the informant's wife was a consenting party and as a matter of fact,

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Rakesh Kumar, Judicial Magistrate 1st Class, Begusarai in connection with Neema Chandpura P.S.
