Petitioner seeks bail in a case registered for the offences punishable under Sections 448, 504, 506, 306, 120B/34 of the Indian Penal Code.
According to prosecution case itself, the deceased committed suicide in his house and the informant being father of the deceased lodged this case against the petitioner and others on the ground that one day prior to the alleged occurrence, the deceased had lodged a criminal case against the petitioner and others and thereafter, petitioner and others had given threatening to him and also put pressure on the deceased through father in law
Patna High Court Cr.Misc. No.11113 of 2016 (2) dt.10-03-2016 2/2 of the deceased.
Learned counsel for the petitioner submits that no case under Section 306 of the Indian Penal Code is made out. On the other hand, learned counsel appearing for the informant vehemently opposed the prayer submitting that petitioner and other accused abetted the deceased to commit suicide.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Rahul Kishore, Judicial Magistrate 1st Class, Begusarai in connection with Phulwaria P.S.
