====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 21-02-2025 Heard Mr. Arun Kumar, learned counsel for the petitioners and Mr. Dilip Kumar No.1, learned APP for the State.

2. The petitioners seek bail in a case registered for the offences punishable u/s 147, 148, 149, 323, 307, 337, 338, 34 of the Indian Penal Code and Sections 25(1-a), 26, 27, 35 of the Arms Act.

3. The informant, being the Inspector-cum-S.H.O. of Hisua Police Station got information that in village Latawar, there was an occurrence of fight and firing in between two groups and petitioners along with others are involved in the said occurrence.

4. It is submitted by learned counsel for the petitioners that the petitioners are quite innocent and have committed no offence. No such occurrence as alleged has ever taken place. They have falsely been implicated in this case due to ulterior motive. The allegation levelled against the petitioners is totally false and based on concocted facts. Nothing specific has been attributed against them. No eye witness has supported the prosecution case. They have been transpired in the present case merely on suspicion. Similarly situated co-accused have been granted anticipatory bail by this Court vide order dated 18.11.2024 passed in Cr. Misc. No. 76178 of 2024. Petitioner no.1 has seven criminal antecedents, whereas petitioner no.2 has five criminal antecedents. Learned counsel further submits that the charge has been framed against the petitioners on 24.01.2025 and they have been languishing in custody since 28.10.2024.

5. Learned APP for the State vehemently opposes the prayer for bail.

6. Considering the arguments of the parties as well as the period of custody, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like
