In this case, the petitioner is seeking anticipatory bail in connection with Kalyanpur Police Station Case No. 197 of 2018 registered for offences punishable under sections 272 and 273 of the Indian Penal Code and 30(a) of the Bihar Prohibition and Excise Act, 2016.

The allegation is of recovery of 6.300 litres of illegal liquor.

The petitioner has a criminal antecedent as mentioned in paragraph 3 of this application.

Looking to the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner and accordingly his prayer for bail is rejected. However, if the

Patna High Court Cr.Misc. No.2499 of 2019(2) dt.21-01-2019 2/2 petitioner surrenders and prays for regular bail, the court below without being prejudiced by this order, will take decision in accordance with law.
