Petitioner seeks bail, who is in custody since 27.06.2022, in connection with Lalganj P.S. Case No. 177 of 2022, F.I.R. dated 15.05.2022 registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code. Allegation against the petitioner is that he along with other co-accused persons have committed the murder of the daughter of the informant by pressing the neck. Learned counsel for the petitioner submits that the petitioner has clean antecedent and he has been falsely implicated in the present case. She further submits that the allegation as alleged in the F.I.R. is false and fabricated and it appears from the F.I.R. that there is general and omnibus

He further submits that the petitioner has been implicated on the ground that the petitioner is husband of the deceased and as per allegation that the accused persons by pressing the neck of the deceased has committed the murder of the daughter of the informant.

Learned APP for the State, on the other hand, on the basis of material available on record and the case diary, vehemently opposed the prayer for bail and submits that the allegation as alleged in the F.I.R. is supported by the medical evidence (postmortem report).

Considering the aforesaid facts that there is direct allegation against the petitioner, I am not inclined to enlarge the petitioner on bail in connection with Lalganj P.S. Case No. 177 of 2022 pending in the Court of Judicial Magistrate 1st Class, Vaishali at Hajipur.

Prayer is refused.
