The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 341, 323, 307, 353, 324, 379, 504, 506 and 34 of the Indian Penal Code. Allegation against the petitioners including 38 FIR named accused persons and 200-250 unknown persons is of assaulting the police personnel by lathi, danda, farsa etc. Learned counsel for the petitioners submits that there is no specific allegation against the petitioners and allegation is general and omnibus. The petitioners have got no criminal antecedent. The similarly situated co-accused have been granted

Patna High Court CR. MISC. No.9285 of 2020(2) dt.29-02-2020 2/3 anticipatory bail by the Co-ordinate Benches of this Court vide order dated 17.10.2019 in Cr. Misc. No.61424 of 2019 and order dated 18.12.2019 in Cr. Misc. No.83734 of 2019. In the aforesaid facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (rupees twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gopalganj, in connection with Bhore P.S. Case No.

150 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure and subject to the following further conditions: (a) The petitioners are directed to join the investigation of the case and when called for by the Investigating Officer in accordance with law. (b) The petitioners shall not hamper the investigation in any manner whatsoever or shall influence any of the witnesses.

(c) The petitioner shall facilitate in the early completion of the investigation and otherwise fulfill all other statutory terms and conditions, so prescribed, in accordance

(d) The petitioners shall not leave India without prior permission of trial Court.
