JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The occurrence took place in the year 1994 but investigation continued till 2007 and it appears from the report of learned Magistrate that the charge sheet was submitted in the year 2007 and the cognizance was taken on 25.07.2007. Furthermore, it appears that one co-accused namely, Jai Singh @ Ajay Singh surrendered before the court below on 17.10.2014 and was granted bail by the court below itself, on the date of his surrender. So far as petitioner is concerned, he is in jail custody since 15.10.2014 without having any specific overt act as well as criminal antecedent.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.19760 of 2015 (4) dt.28-09-2015 2/2 well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Gaya in connection with Chandauti P.S.Case No.126 of 1994.
