JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-02-2020 Heard learned counsel for the petitioner and the State. The petitioner is apprehending arrest in connection with Beur P.S. Case No. 270 of 2019 for the offence under Section 30(a) of Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that petitioner is the owner of the van which was used for allegedly transporting liquor. The vehicle was apprehended by the police containing liquor.
Considering the fact that the petitioner has no criminal antecedent and nothing was recovered form the conscious possession of the petitioner, the Court is inclined to grant bail to the petitioner named above, in the event of arrest or surrender within four weeks from today, on furnishing bail bond of
Patna High Court CR. MISC. No.7299 of 2020(2) dt.29-02-2020 2/2 Rs.50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of Special Judge (Excise), Patna in connection with Beur P.S. Case No. 270 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
