2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 303(2), 317(5) and 3(5) of the BNS.

3. The case of the prosecution, in short, is that police found that four persons were sitting on a platform and started fleeing away seeing the police party and later on they were apprehended.

4. Learned counsel for the petitioner submits that the allegation levelled against the petitioner is general and omnibus. Learned counsel for the petitioner has submitted that recovery of mobile was done from the possession of the petitioner. No incriminating article has been recovered. Learned counsel for the

5. Learned Additional Prosecutor for the State has vehemently opposed the bail application of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Katihar Rail P.S. Case No. 173 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Katihar.
