The petitioner seeks bail in connection with Sessions Trial No. 364 of 2015 arising out of Ganga Bridge P. S. Case No. 70 of 2012 registered under Sections 302 and other Sections of the I.P.C.

The allegation against the petitioner Kamta Rai and co-accused Muneshwar Rai is that they caught the hands of the deceased and Bhuneshwar Rai given fatal blow with Dab on the abdomen of the deceased.

It is submitted by learned counsel for the petitioner that Muneshwar Rai and the petitioner only caught the hands of the deceased. Muneshwar Rai has already bee granted bail vide

Patna High Court Cr.Misc. No.9975 of 2016 (3) dt.03-08-2016 2/2 Criminal Misc. No. 57952 of 2015. Bhuneshwar Rai who is the main assailant who has given Dab blow on the abdomen of the deceased has also been granted bail vide order dated 12.07.2016 in Criminal Misc. No. 19036 of 2016 by a co-ordinate bench of this Court.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned District and Sessions Judge, Vaishali at Hajipur in connection with Sessions Trial No. 364 of 2015 arising out of Ganga Bridge P. S. Case No. 70 of 2012.
