JUSTICE PRABHAT KUMAR JHA ORAL ORDER 16-06-2015 Heard learned counsel for the petitioner, learned counsel for the informant as well as learned counsel for the State. The petitioner seeks bail in Basnahi P.S. Case No. 08 of 2014, corresponding to Sessions Trial No. 2375 of 2014/2429 of 2014, registered for the offences punishable under Sections341, 323, 325, 302, 504 and 506 of the Indian Penal Code and under Section 27 of the Arms Act.

The petitioner along with other accused persons are named in the FIR, but there is specific allegation against Amol Yadav who is said to have fired at his armpit. Khokha Yadav is said to have assaulted Pawan Yadav on his head with butt of pistol.

It is submitted that no specific allegation of assault is

Patna High Court Cr.Misc. No.18579 of 2015 (2) dt.16-06-2015 2/2 made against the petitioner Sanjiv Yadav. Other similarly situated co-accused persons have already been enlarged on bail. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri N.K.P. Gupta, the learned Additional Sessions Judge IInd, Saharsa in Basnahi P.S. Case No. 08 of 2014, corresponding to Sessions Trial No. 2375 of 2014/2429 of 2014. However, the trial court is directed to expedite the trial and conclude the same as soon as possible.
