====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 18-02-2019 Heard learned counsel for the petitioners and learned counsel for the State.
In this case, the petitioners are apprehending their arrest in connection with Manihari P.S. Case No. 267 of 2018 registered for offences under sections 341, 323, 307, 504, 379, 354-B/34 of the Indian Penal Code.
As per prosecution story, when the Informant and his family members were performing Chhath Puja, the accused persons including the petitioners arrived there, abused them and misbehaved with the female members. After Puja, when the Informant and his family members were taking seat for returning, all the accused persons again surrounded and
Patna High Court Cr.Misc. No.2902 of 2019(3) dt.18-02-2019 2/2 assaulted them.
Looking to the nature of allegations made against the petitioners as also considering the entire facts and circumstances of the case, this Court is not inclined to grant privilege of anticipatory bail to the petitioners. Accordingly, the prayer for anticipatory bail of the petitioners, above named, is rejected.
If the petitioners surrender before the court below within a period of three weeks from today and pray for bail, the court below, without being prejudiced by this order, will take a decision in accordance with law.
