The petitioners are accused in connection with Babubarhi P.S. Case No. 02 of 2015 corresponding to G.R. No. 49 of 2015 registered under Sections 401, 414, 420, 467, 468, 471 and 472/34 of the Indian Penal Code.
On information of C.I.D. that in the rented house of Surya Narayan Yadav miscreants are operating a gang of motorcycle lifter, raid was conducted, where four persons including the petitioners were apprehended. On the basis of confessional statement of petitioner Mithalesh Kumar Singh,
Patna High Court Cr.Misc. No.18744 of 2015 (3) dt.09-09-2015 motorcycle was also recovered from the shop of Santosh Kumar Mandal.
Learned counsel for the petitioners submits that when petitioners were moving in front of the house of Surya Narayan Yadav then police apprehended mere on suspicion. It is further submitted that petitioners having no criminal antecedent are in custody since 09.01.2015. Further submission is that submits that co-accused, Santosh Kumar Mandal, has already been granted privilege of bail by a Bench of this Court vide order dated 30.03.2015 passed in Criminal Misc. No. 12124 of 2015. Having regard to the facts and the circumstances of the case, the petitioner above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the J.M. Ist Class, Madhubani, in connection with Babubarhi P.S. Case No. 02 of 2015/G.R. No. 49 of 2015. Out of two sureties, one surety must be the parents or close relative of the petitioner.
