Petitioner is not named in the first information report but from perusal of the impugned order, it would appear that witnesses claimed to know the name of the petitioner on the basis of conversation of the dacoits and except the aforesaid material as well as criminal antecedent of the petitioner, there is nothing against the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Saran at Chapra in connection with
