The petitioners apprehend their arrest in Meerganj P.S. Case No.68 of 2018 registered under Sections 307, 353, 224 and other Sections of the Indian Penal Code.
The gist of the allegation is that while the police arrested the accused of Meerganj P.S. Case No.67 of 2018, namely, Mangal Murmu, Ajay Murmu, the female members of the village came and started quarrel with the police officials and they got the apprehended accused free from the custody of the police. The informant claimed to identify the petitioners among the ladies.
The learned counsel for the petitioners submits that no case is made out under Section 307 of the I.P.C. Petitioner No.1
Patna High Court Cr.Misc. No.5179 of 2019(2) dt.30-01-2019 2/2 is the wife of Mangal Murmu. All the petitioners are ladies. No injury was caused to any of the police officials. Considering the aforesaid facts and nature of allegation made against the petitioners and the fact that petitioners are ladies, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with Meerganj P.S. Case No.68 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
