JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2020 Petitioner seeks regular bail in connection with Special Case No. 11111 of 2019 arising out of Excise Case No. 270 of 2019, registered for the offence punishable under Sections 30(a), 32(1), 32(3), 41(1) and 41(2) of the Bihar Prohibition & Excise Act, 2018.

Recovery of 85.140 liters of foreign liquor from a car and petitioner was also arrested from the car. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case. The car does not belong to him. He was only a driver. He is in custody for one month, having no criminal antecedent. Charge sheet has already been submitted in this case, as such, there is no chance of tampering with the evidence.

No.2125 of 2020(2) dt.16-01-2020 2/2 Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Special Judge, Excise Act, Patna, in connection with Special Case No. 11111 of 2019 arising out of Excise Case No. 270 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
