The present Appeal has been filed for grant of anticipatory bail against the order dated 16.11.2024 passed by the learned District and Additional Sessions Judge-1st-cumSpecial Judge (SC & ST), Bettiah, West Champaran in ABP No. 1692 of 2024 which was rejected in connection with Ramnagar P.S. Case No. 287 of 2024 registered for the offence under sections 341, 323, 354B, 504, 506/34 of the IPC and Section 3 (1)(r)(s)(w) 3(2)(va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

3. As per the FIR, allegation against the petitioners is that he along with the other accused persons has assaulted and abused the informant and his family members by their caste name.
4. Learned counsel for the appellant submits that appellant is innocent and has been falsely implicated in this case. He further submits that FIR has been lodged after the delay of three days. He further submits that from injury report, it seems that all the injury sustained by the injured are simple in nature which has been caused by hard and blunt objects. He further submits that Appellant no. 1 possesses four criminal antecedent and Appellant No. 2 possesses clean antecedent.
5. Learned S.P.P. opposes the prayer for anticipatory bail.
6. On perusal of FIR and impugned order dated 16.11.2024, it appears that the injury sustained by informant are all simple in nature and there is no specific allegation against Appellant No. 2 and had clean antecedent. So, let the above named Appellant No. 2 be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge-1st-cum-Special Judge (SC & ST),

7. So far as Appellant No. 1 is concerned, he possesses four criminal antecedent and have specific allegation against him. Therefore, anticipatory bail application of the Appellant No. 1 is rejected.
8. Accordingly, the anticipatory bail applications of the appellants are disposed off.
