2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 323, 379 and 366 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and has falsely been implicated in the instant case by the informant with an allegation that accused persons including the petitioner enticed his minor daughter aged about seventeen years for the purpose of marriage and kidnapped her on 01.03.2021. It is further submitted that Pawan Kumar had approached this Court seeking anticipatory bail by filing Cr. Misc. No. 55201 of 2024 and the same was allowed vide order dated 02.09.2024. It is further
Patna High Court CR. MISC. No.4607 of 2025(2) dt.05-03-2025 2/3 submitted that the case of the petitioner, if not akin, is similar to that of Pawan Kumar. It is lastly submitted that this Court while granting anticipatory bail to Pawan Kumar had considered the case in detail and on merit.
4. Learned Additional Public Prosecutor for the State opposes the prayer for anticipatory bail of the petitioner.
5. Considering the submissions made by the learned counsel for the petitioner and also taking into consideration the order dated 02.09.2024 passed in Cr. Misc. No. 55201 of 2024, the petitioner above-named, in the event of his arrest or surrender before the learned trial Court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of the learned trial Court, where the case is pending / successor Court, in connection with Manjhagarh P.S. Case No. 283 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
6. However, it is made clear that the informant shall be at liberty to file an application seeking cancellation of anticipatory bail granted to the petitioner, in the event, if the victim has not been married as pleaded at paragraph no. 11 of
Patna High Court CR. MISC. No.4607 of 2025(2) dt.05-03-2025 3/3 the anticipatory bail application or has not been recovered till date.
