Mr.Ashok Kumar Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-01-2020 Heard the learned counsel for the petitioners and the learned A.P.P. for the State.

This is an application for grant of anticipatory bail in connection with Jalalgarh case no. 102 of 2019 registered for the offences punishable under Sections 341, 342, 353, 427, 504, 506/34 of Indian Penal Code.

The allegation is regarding the accused persons including the petitioners herein having abused the S.B.O. and the

Patna High Court CR. MISC. No.3884 of 2020(2) dt.21-01-2020 2/3 Night Guard on account of the village of the accused persons not receiving electricity since past 03 days.

The learned counsel for the petitioners has submitted that the petitioners have been falsely implicated in the present case and they are having clean antecedent. It is further submitted that there are general and omnibus allegations levelled against the accused persons and there is no whisper of any sort of grievous injury having been sustained by the S.B.O., hence there is no impediment in granting anticipatory bail to the petitioners herein. However it is submitted that the petitioners undertake to keep good behaviour in future, failing which their privilege of anticipatory bail may be withdrawn, in case the court is granting anticipatory bail to the petitioners herein.

Having regard to the facts and circumstance of the case and considering the submissions made by the learned counsel for the petitioners coupled with the fact that the petitioners are having clean antecedent and there is no whisper of any sort of grievous injury being inflicted on the informant, I deem it fit and appropriate to admit the petitioners to the privilege of anticipatory bail. Accordingly, the abovenamed petitioners, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/ production of a copy of this order, are directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount
