Unknown miscreants were persistently demanding ransom from the informant Dinanath Prasad and in its continuity, on 21.07.2014 raided his shop, thrown pamphlets asking for payment of ransom as well as also fired in order to terrorize.
Gone through the case diary wherefrom it is apparent that son of informant Rahul Kumar (para-8) had claimed identification of one of the culprit as Raushan which has also been corroborated by the other witnesses. Furthermore, as per para-47, call details it is apparent that Raushan as well as Umesh Kumar had dialed over mobile belonging to the informant. So far petitioner is concerned his complicity happens to be on the basis of inadmissible evidence, a disclosure made by the spy along with his own inculpatory extra judicial confessional statement during course of his apprehension in connection with Shyampur Bhatnha P.S. Case No.82 of 2014.
Patna High Court Cr.Misc. No.18039 of 2015 (3) dt.02-07-2015 Accordingly, Ratnesh Kumar Yadav is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned SDJM, Sikrahana, East Champaran at Motihari in connection with Rajepur P.S. Case No.89 of 2014.
